Typically, private organizations which contract to provide goods or services to the public, and then are reimbursed by public funds for the goods or services provided are not subject to the OMA, as long as they are not "supported" by public funds.

This opinion deals with public comment. A public body which voluntarily chooses to allow for public comment may limit comment to items on the agenda and provide on the agenda that comments are limited.

The Governor's Security and Preparedness Executive Panel is not subject to the OMA - because the Panel is not a public body.

The Council on Judicial Complaints, an agency of the Executive Department, is not subject to the OMA when conducting, discussion, or deliberating any matter relating to a complaint.

A willful violation of the OMA makes the action invalid.

Both the OMA and the ORA apply to governing boards of counties and to all bodies supported in whole or in part by public funds or entrusted with the expenditures of public funds, so the Association of County Commissioners Self Insurance Fund and Self Insurance Group must comply with the OMA.

The OMA does not provide for or guarantee citizens the right to participate in the governmental decisions being made at an open meeting, nor a right to express their views on the issues being considered at the meeting in the form of a public comment.

OMA is to be liberally construed in favor of the public. Public notice is required to be posted in prominent public view and must be conspicuously posted for at least 24 hours prior to the meeting in a location at its principal office, which is easily accessible and convenient to the public.

A public body may not keep confidential the purpose of an executive session pursuant to 25 O.S. § 307(B)(1), in which it discusses the employment, hiring, appointment, promotion, demotion, disciplining or resignation of an individual salaried public employee.

The person employed as the "minute clerk" is not required to take the minutes of a board of education's executive session. Any person legally present may take the minutes - however, they must be taken, and any willful violation will cause the minutes or any other records to be made public.

A public body, such as a board of education, may go into executive session for the purpose of discussing the salary of an individual salaried public officer or employee. NOTE: this opinion withdraws 1978 OK AG 201.

Members of a public body may discuss public business outside of a meeting so long as a majority of the public body is not present for the conversation.

Board of County Commissioners may hold an executive session to discuss the appointment of an in individual to fill a vacancy in an elective county office. But, the executive session provisions in the OMA do not create any legal privilege that requires matters to be kept confidential.

Discusses how specific or detailed an agenda item must be on what is to be discussed in an executive session for purposes of hiring an employee.

The Oklahoma Linked Deposit Review Board is subject to the OMA - because it is supported in whole or in part by public funds, invested with the authority to oversee the expenditure of public funds, or the duty to administer public property.
