Where the charter of a home-rule city provides all city council meetings shall be open to the public, the council may not go into executive session, unless the city charter is amended to allow such sessions. NOTE: this was overruled by City of Kingfisher v. State, 1998 OK CIV APP 39, 958 P.2d 170.

The OMA applies to business meetings of the board of a nonprofit corporation concerning contracted matters, when the corporation has contracted with a city and a public trust for the maintenance and improvements of a park and annual appropriations are made to the corporation as an operating fee.

The procedure employed by the Pardon and Parole Board allowing members to cast their vote by mail goes against the OMA - therefore, it is invalid.

An unincorporated association, or other entity, which has been given actual or de facto decision-making authority by a school district, is subject to the OMA.

Attorney-client privilege does not attach in all matters. This opinion lists specific instances when it does not attach; therefore, the meetings should remain open to the public.

The Student Government Association and the Residence Halls Associations are sub-entities of a board of higher education. These sub-entities have actual or de facto decision-making authority, and therefore are subject to the OMA.

In any meeting of the board, the contents of the teacher evaluations and responses may not be disclosed to anyone other than those designated in 70 O.S. § 6-102.3, unless the teacher, who is the subject of the evaluations and responses, affirmatively waives confidentiality.

The exclusion of competitors for a state contract from a meeting of the State Board of Corrections violates the OMA.

A legislator, who is also a member of a legislative education committee, does not have a statutory right to attend the executive sessions of a board of education where individual employment matters are discussed. But, a local board may, in exercising its judgment and discretion, permit it.

This opinion deals with matters of the OK Tax Commission and the manner in which they can keep some matters confidential through the OMA.

Where a private not for-profit hospital is created for the purpose of leasing public property for public use, it is "administering public property" pursuant to 25 O.S. § 304 and would be a public body subject to the OMA, regardless of whether such lease is obtained from a county or public trust.
